Coincidentally the only time I've seen him take a "good" penalty was when the keeper went the right way.
Against Chelsea in pre season he put it hard into the corner and the keeper got a hand on it but not enough.
You can make a signing any time you like with it becoming active when defined.
Best example I can think of is Keita at Liverpool.
They signed him a year before he joined them. He had a release clause that would become active the following summer so they paid a bit more than that release...
